In view of the communiqué issued by the Ministry of Commerce and Industries, informing of the receipt of notifications of intent to file arbitration claims under the Free Trade Agreement between Panama and Canada, the company wishes to clarify that:
The purpose of the notification is merely to comply with the legal formalities required by international treaties, with the purpose of opening between the parties a period of dialogue of at least 90 days.
Such notices are not the initiation of arbitration, but on the contrary, are intended to avoid the need for arbitration by allowing the situation to be resolved during the 90-day period.
The company is fully confident in its solid legal position and its intention has always been to open channels of dialogue to find conciliatory solutions in strict compliance with the law and international treaties, always reserving the right to activate other measures to defend its investment made in good faith.
